Grant of Probate & Letters of Administration Hornchurch
It is already a very distressing time when dealing with the loss of a loved one, and we at Moss and Coleman are keen to take the burden of dealing with paperwork away from you.
What is it? A Grant of Probate is issued by the Court to an Executor named in a Will; a Grant of Letters of Administration is issued to the Court in cases where there is no Will. The person named on the Grant is the person that has authority to deal with the assets of the estate of the person that has passed away.
Why do I need it? This is your authority to be able to act – if there is a property to be sold, or cash in a bank account, shares or an insurance policy to claim, you are going to be asked to produce a copy of the Grant.
How can we help? We offer two sets of services, the first obtaining the Grant to the estate, which will include dealing with the Inheritance Tax return to HMRC and applying to the Probate Registry for the Grant. The second is that we deal with the full administration of the estate, the details of which are set out below.
Administration of Estate Hornchurch
A full estate administration starts with obtaining the financial details of the deceased, submitting the Inheritance Tax return to HMRC and applying to the Probate Registry for the Grant; once the Grant is issued, the assets can be collated and then distributed in accordance with the terms of the Will or distributed in accordance with the Intestacy Provisions if there is no Will; the Intestacy Provisions are a statutory set rules about who inherits from your estate and in what order.
Our lawyers will ensure that all legal responsibilities are met and that the estate is administered correctly.
